Employment Equity Amendment Act and Regulations
2023 EE Reporting period
Since the Employment Equity Amendment Act and its regulations have not been enacted as yet, the status quo in respect of reporting remains unchanged.
Consequently, all designated employers, must submit their 2023 EE reports using the current Act and regulations. This includes employers employing less than 50 employees but with a turnover exceeding the thresholds in the Act.
The 2023 EE reporting period will open on 1 September 2023, and close on 15 January 2024.
This delay in enactment should not be viewed as a deviation by Government from its intention to implement draconian race-based legislation but is in all likelihood a result of technical legislative issues.
NEASA stands at the ready to challenge any legislation that attempts to infringe upon the right of employers to run their business as they see fit, including the right to appoint the best person in any position, which is the exact aim of the current employment equity legislative drive.
