EXTENDED PARENTAL LEAVE
MATTER GAINS CONSIDERABLE PARTICIPATION

Dear employer

As previously communicated, NEASA applied, on 31 January 2023, to be admitted as an amicus curiae to a High Court matter, in order to oppose the application for the extension of 4 month’s maternity leave to fathers. This application was granted. 

Five other parties, all in support of the application for the extension of said leave, were also joined to the matter as amici curiae. In addition to this, the Commission for Gender Equality filed an application to intervene in the main matter, as it considers itself to have a direct interest. 

From the now increased legal participation by various parties in the labour sphere, it becomes evident exactly how important this matter is to all parties affected by the possible extension of maternity leave to fathers.

The matter has been set down for 24-26 April 2023 in the High Court of Johannesburg. 

NEASA will keep employers abreast of the developments in this regard.
