IMPLEMENTATION OF
AGREEMENT
Dear employer
As previously communicated, the Bargaining Council for Fast Food, Restaurant, Catering and Allied Trades recently extended its Main Agreement to non-parties in the industry, thereby forcing all employers in the sector to comply with the conditions of employment as set out in the Agreement.
However, the Labour Court has granted an urgent interdict, brought by the Federated Hospitality Association of South Africa, preventing the Bargaining Council from implementing the Agreement, pending the finalisation of an application to review the Minister’s decision to extend the Agreement.
The effect of this is that employers who are not a member of any of the organisations which signed the Agreement, do not need to register with the Bargaining Council or comply with the conditions of employment as contained in the Main Agreement.
