PAYMENT FOR PUBLIC HOLIDAYS

Dear NEASA employer

16 June 2024 is a public holiday and falls on a Sunday this year. 


In terms of the Public Holiday Act, if a public holiday falls on a Sunday, the following Monday will also be regarded as a public holiday. This means that 17 June will also be a public holiday this year. The question as to how employees should be paid in this instance has been answered by the Labour Appeal Court a number of years ago. The Court determined that the Monday was not intended to replace the Sunday public holiday but is in addition to the Sunday. The effect of this is as follows:


 

If employees do not normally work on a Sunday: 


Sunday Pay: 


The employees receive no remuneration for the Sunday. 


Monday Pay: 


If the employees normally work on a Monday, they are entitled to their normal pay for that day if not required to work. If employees do work, they are entitled to at least double the wage they would have ordinarily received for working on that day.


 

If employees normally work on a Sunday and Monday: 


If the employees don’t work, they receive the wage they would have ordinarily received for work on those days. 


If the employees work on both days, they must be paid at least double the wage they would have ordinarily received for working on those days.
