The Labour Court, on Friday, found the ongoing strike in the Plastics Sector to be protected as the Court determined that it could not pronounce on the merits of a demand and that the issue must be resolved by way of negotiations.
Therefore, employers cannot discipline employees for participating in the strike, but can discipline them for misconduct committed during the strike.
Employers who are experiencing incidents of violence can contact their regional offices for assistance in this regard.
In the interim, negotiations are continuing under the auspices of the CCMA in an attempt to resolve the issue.
